Accordingly! our position is that! firstly! three sanctions for the same type of violation – contradicts legal logic and common sense. State customers have limited the profit of Ukrainian weapons manufacturers by an Changes to legislation average of 5-7%. And the amount of fines for the first month of delay together is 13% and doubles the potential profit received by the supplier for the year. Under such conditions! Ukrainian weapons manufacturers not only have to deliver goods at a loss! but also take their own money out of their pockets and pay extra to the state.
Therefore! we propose to resolve problematic issues in the legislation
Specifically! out of the three types of fines for one violation! leave only one – the most effective. This is a penalty! which is accrued daily and amounts to 0.1% per day.
Accordingly! the other two staffs need to be removed.
The other day! we removed the second of line data three sanctions: a fixed penalty of 7%! which is Changes to legislation charged once per month of delay.
Next on the agenda is a review of the third of the three fines. These are amendments to the Civil Code! which provide for a fine of 3% per month for the so-called “use of funds.”
Why is it called so? It is worth explaining here that no executor of a state defense contract can freely use advance funds. The money does not go to their accounts! but to the State Treasury. The funds can only be used to pay for components! spare parts! or subcontractors! after providing a payment slip and a contract. Then the Treasury releases the money.
